Terms of Service

1. The service

Let's Make Your App Great Again ("LMYAGA") provides website and application modernization services, including redesign, hosting, ongoing maintenance, and AI-assisted development, to businesses across Massachusetts.

2. The 12-month hosting commitment

All plans include a 12-month hosting and maintenance commitment. The free redesign (for standard projects) and any project work (for complex builds) are delivered as part of this commitment. By proceeding past the free mockup and going live, you agree to the 12-month term.

After 12 months, you own all source files outright and may cancel at any time at no cost. You are also welcome to continue on the monthly plan.

3. Early exit and buyout

If you need to exit before the 12-month commitment is complete, a buyout fee applies:

Buyout = Fair market value of work delivered − Monthly payments made to date

For standard projects, the fair market value of a redesign is approximately $1,500. For complex projects, the fair market value is the scoped project cost agreed upon in the proposal. The buyout amount decreases the longer you remain a client.

4. Payment terms

• Monthly hosting and maintenance is billed at $99/month (or the agreed rate for compute-heavy applications). Billing begins on the date your product goes live.
• Complex project phases are billed per milestone as agreed in the scoped proposal.
• The $50 live demo fee is non-refundable. If you proceed with a plan, the $50 is credited toward your first month.
• Compute-heavy applications are billed at actual infrastructure cost plus a management margin, disclosed in the scoped proposal.

5. Ownership

Upon completion of the 12-month commitment, all source files, assets, and code produced for your project are transferred to you in full. Prior to month 12, LMYAGA retains ownership of all deliverables unless a buyout has been completed.

6. Limitation of liability

LMYAGA is not liable for any indirect, incidental, or consequential damages, including lost revenue or lost profits, arising from the use or inability to use the service. Our total liability in any case is limited to the monthly fees paid in the three months prior to the claim.

7. Governing law

These terms are governed by the laws of the Commonwealth of Massachusetts, United States. Any disputes will be resolved in the courts of Essex County, Massachusetts.
